Petitioner is aggrieved by the inaction of the police authorities as the representation dated 27.03.2025 so addressed to the Inspector-in-Charge of Basanti Police Station was not acted upon. Petitioner has enclosed the medical documents and drawn the attention of the Court to the said documents.

State has submitted a report. Report reflects that Basanti Police Station NCR no. 122/25 dated 12.04.2025 has been registered under Section 115(2) of the BNS against Pramatho Ranjan Somaddar, Tanmoy Somaddar and Rahul Haldar.

Learned advocate appearing for the respondent no.4 submits that Pramatho Ranjan Somaddar one of the

respondents have already expired after the writ petition was preferred.

Be that as it may, police authorities have already drawn up a NCR case. Petitioner would at liberty to invoke Section 174 of the BNSS. If the petitioner is of the opinion that a FIR need be registered for assistance of the police authorities to complete the investigation and take the investigation to its logical conclusion.

Police authorities would keep a strict vigil to that no untoward incident results because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations WPA 9404 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
