Mr. Soumya Majumdar Mr. Soumyajit Mishra ... for the petitioner Mr. Arjun Ray Mukherjee ... for the State respondents The writ petitioner claim that they are belong to the economically weaker sections of the society. Their properties were destroyed by the cycle Amphan on May 20, 2020. The writ petitioners have applied before the Block Development Officer, Mathurapur: II Block in the District of 24 Parganas South for payment of financial benefit under the scheme framed by the Government of West Bengal in this regard.

The petitioner prays for a direction upon the respondent authority to make an enquiry into the claims of the writ petitioners and to disburse the financial benefits which they are entitled to.

The learned advocate on behalf of the State submits that an enquiry into the claims of the writ petitioners have already been made. He submits that out of 97 writ petitioners only 55 writ petitioners are entitled to the

financial benefit under the said scheme. The concerned respondent authority being the respondent no.5 i.e. the Block Development Officer, Mathurapur : II Block, has already taken a decision in this regard.

The financial benefit in terms of the said scheme is to be disbursed by the respondent no.5 i.e. Block Development Officer, Mathurapur : II Block, Post OfficeBakultala in the District of 24 Parganas South in favour of the said 55 writ petitioners as expeditiously as possible and positively by three weeks from date.

In so far as the rest 42 writ petitioners are concerned, who according to the respondent authorities are not entitled to the financial benefit under the said scheme, the reasons for rejection of their claim is to be communicated to the said 42 writ petitioners within a week from date.

Accordingly, W.P.A 6938 of 2020 and I.A No. CAN 1 of 2020 are disposed of with the aforesaid directions. (Hiranmay Bhattacharyya, J. )
