The petitioner was serving the Bose Institute. A disciplinary proceeding was initiated against him and punishment imposed.

The petitioner challenged the order of punishment before this Court by filing writ petition being WPA 7057 of 2020 which stood disposed of by allowing the same on November 24, 2025.

The Court categorically held that no fruitful purpose will be served in directing reconsideration of the enquiry officer's report by the disciplinary authority as the petitioner already reached the age of superannuation and the master servant relationship ceased.

The employer, i.e., Bose Institute preferred an appeal being FMA No.399 of 2026 against the said
judgment and the same is submitted to be pending consideration before the Court.

The petitioner has made a representation seeking release of his entitlements in April 2026 which is alleged to be kept pending.

Prayer has been made to direct the authority to disburse the admitted dues pending disposal of the appeal.

Learned advocate representing the Bose Institute submits that the representation made by the petitioner has been addressed to the Acting Registrar of the Institute. There is no such post. Presently, the Registrar (Officiating) will be the person responsible to consider and dispose of the petitioner's prayer. 8.
As it appears that the representation filed by the petitioner is pending consideration before the authority, accordingly, without entering into the merits of the same, the writ petition stands disposed of by directing the Registrar (Officiating), Bose Institute being the respondent no.4 herein to take a decision on the petitioner's representation strictly in accordance with law at the earliest, but positively within a period of eight weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner.

The admitted dues of the petitioner, if any, shall be disbursed without any further delay.

Learned advocate for the petitioner is directed to forward a copy of the subject representation to the aforesaid respondent at the time of communicating the order of the Court.

Since no affidavit in opposition has been invited, the allegations contained in the writ petition are deemed not be admitted by the respondents.

The steps taken by the authority to consider the representation and making payment thereof, if any, shall abide by the result of the pending appeal. 13.
Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
