Mr. Sahajan Sarkar Mr. Imadul Biswas ...for the petitioneras Mr. Rajib Mukherjee ..for the respondents This writ petition has been filed challenging inaction on the part of the Telecom District Manager, BSNL, Raiganj SSA Sanchar Dishari, Karno Jora, Uttar Dinajpur in disposing of the representation of the petitioners for their re-engagement as casual workers. It is the contention of the petitioners that the petitioners are not seeking enforcement of the award dated August 9, 2018 but were making a simple prayer for re-engagement. Mr.

Mukherjee, learned Advocate for the respondents submits that in view of the policy taken by the Telecom Department dated February 12, 1999 to do away with engagement of casual workers in BSNL, the petitioners'

representation cannot be considered.

It appears that the petitioners made a representation dated March 23, 2021 but the same has not been disposed of. The petitioners are at least entitled to know the fate of

such representation.

This Court has not gone into merits of the claims and counterclaims of the parties. The General Manager, Telecom Raiganj SSA, Sanchar Dishari, Karno Jora, Raiganj, Uttar Dinajpur, the respondent no.3 is directed to dispose of the representation of the petitioners in accordance with law and on the basis of the policy adopted by the BSNL contained in the prevailing circular of the Telecom Department. A reasoned order shall be passed and communicated to the petitioners within a period of six weeks from the date of communication of this order.

This writ petition is disposed of.

There will be however no order as to costs.

All parties are directed to act on the server copy of this order.
