Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner is aggrieved by the fact that the private respondents have been raising construction without converting the land. To that effect, information was furnished to BL&LRO, Joynagar-I as also the Inspector-in-Charge, Joynagar Police Station.

So far as the issue relating to conversion of land is concerned, that is the exclusive domain of the BL&LRO concerned. The police authorities are not empowered to interfere with the same until and unless a specific complaint is received from the office of the BL&LRO concerned. Police authorities, however, are well aware regarding the nature of the incident complained of. Accordingly, proceeding has been drawn up under Section 126 of BNSS.

Considering the fact that the petitioner's main grievance is in relation to the construction over a property, I am of the view that the petitioner will

approach the appropriate authorities under the relevant provisions of law.

So far as the other issues are concerned, police authorities would only restrict themselves to oversee that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations, the writ petition being WPA 9292 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
