1. It is submitted on behalf of the petitioner that he is in custody for about five years. Accordingly, he prays for bail.

2. State submits report giving timeline for conclusion of trial.

3. We have considered the materials on record. There are incriminating materials implicating the petitioner in the murder. Offences, if proved, would attract mandatory life imprisonment. Time schedule proposed by the prosecution shows remaining witnesses i.e. nineteen in number may be examined on nine dates i.e. around two witnesses per day. In view of the aforesaid assurance given by the prosecution, we are not inclined to grant bail to the petitioner at this stage.

4. The application for bail is thus rejected.

5. Trial court is directed to expedite the trial by fixing schedules at short intervals and conclude the same as expeditiously as possible preferably within one year from the next date fixed for recording Signed By :

evidence subject to cooperation by the defence and systemic delays. Parties shall cooperate with the trial court in that regard.
