09.06.2022 TN WPA No.8948 of 2022 Khokan Sing and another Vs.

The West Bengal State Electricity Distribution Company Limited and others Mr. Soumen Kr. Dutta, Mr. Sabyasachi Bhattacharjee .... for the petitioners Mr. Debjit Mukherjee .... for the WBSEDCL Mr. Pinaki Ranjan Mitra .... for the intervenor Learned counsel for the petitioners contends that without any permission or consent of the petitioners, a high-tension line which has been existing in the locality for a long time has been sought to be relocated and placed over a major portion of the land of the petitioners, thereby adversely affecting the petitioners'

ownership and enjoyment of their property, that is, plot no.144.

Learned counsel appearing for the West Bengal State Electricity Distribution Company Limited (for short "the WBSEDCL") hands over a communication received from his client that at present, due to

objection of several local people, the work of shifting the line has been stopped and there is no possibility of drawing the high-tension line over the land of the petitioners. The said communication be kept on record.

Keeping in view the said communication, it is evident that the cause of action for filing the writ petition has spent its force, since the WBSEDCL itself submits that the work of shifting has been stopped. Hence, WPA No.8948 of 2022 is disposed of as infructuous.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
