The revisional application was preferred challenging the order dated 26.03.2021 passed by the learned Chief Judge, City Sessions Court, Calcutta in Criminal Appeal No. 276 of 2019 wherein the learned Chief Judge as an appellate court was considering the subject matter of the order passed by learned Metropolitan Magistrate, 12th Court, Calcutta in Misc. Case No. 32 of 2018 under Section 12 of the Protection of Women from Domestic Violence Act, 2005. The learned appellate court took into account the interim relief of Rs.5000/- per month which was awarded to the applicant before the trial court and on the reason of domestic relationship existing between the parties held that prima facie case being made out as there is matrimonial discord for which the parties are staying separately was pleased to affirm the quantum so awarded by the learned Metropolitan Magistrate, 12th Court, Calcutta.

Having considered the reasons so assigned by the learned Chief Judge, City Sessions Court, Calcutta, I am of the opinion that no interference is called for.

With the aforesaid observations, the revisional application being CRR 1283 of 2021 is disposed of.
