There are some deficiencies in investigation and the Investigating Authority who was not serious while submitting the charge sheet. In view of the aforesaid, at this stage, there is no scope for this Court to interfere with the prayer of the petitioner for cancellation of bail. Further the petitioner is granted liberty to prefer an application under Section 173(8) of the Code of Criminal Procedure before the jurisdictional Court, if such an application is preferred, the Learned Court would dispose of the same within a period of seven days from the date of preferring such an application. Thereafter, if circumstances so arise, the petitioner would be at liberty to take out an

application of the same nature for interference with the bail granted by the Learned Magistrate.

With the aforesaid observations, CRM (SB) 98 of 2022 is disposed of.

The Investigating Officer is present before this Court. His further appearance is dispensed with.
