IA No. CAN 1 of 2020 is allowed in view of the urgency involved.
Despite service, none appears on behalf of the opposite party no.2, although the petitioner and the opposite party no.1 are represented through counsel in Court today.
In view of the innocuous nature of the order proposed to be passed, no further service of notice on the opposite party no.2 is deemed necessary.
C.O. 1195 of 2020 is disposed of by directing the Recovery Officer, Debts Recovery Tribunal-I, Kolkata to hear and decide the application for
dismissal, pending before the said Recovery Officer at the behest of the present petitioner, at the earliest, prior to disposal of R.C. No.207 of 2015. Thereafter, the concerned Tribunal as well as the Recovery Officer are requested to dispose of the other pending interlocutory applications as well, prior to disposal of R.C. No.207 of 2015, as expeditiously as possible. There will be no order as to costs.
