1. Complaining non-compliance of the order dated 12th December, 2025 on the part of the Chairman, Raghunathpur Municipality to act in accordance with the order dated 12th December, 2025 and to decide the issue referred to it upon affording an opportunity of hearing to the petitioner and by passing a reasoned order, the instant contempt application has been filed.

2. Mr. Mitra, learned advocate representing the petitioner would submit that though the petitioner had communicated the aforesaid order, and though an opportunity of hearing was afforded to the petitioner, the Chairman of the said municipality has only subsequent to the filing of the contempt application, served the petitioner with the reasoned order which according to him is back dated.

3. Having heard the learned advocate for the petitioner, I find that since an order has already been passed and

CPAN 562 of 2026 since, a decision has already been taken by the municipality to disburse the forfeited earnest money and release the same, the contempt application can no longer be maintainable.

4. The same is accordingly dismissed by retaining the order dated 20th January, 2026 in the file.

5. The aforesaid dismissal shall not interfere with the rights of the petitioner to seek enforcement of the above order in accordance with law, if so advised.
