Mr. Nilanjan Adhikari Mr. Nitin Sharma Ms. Oindrila Sinha ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 1st Court at Barasat to dispose of the Title Suit No. 467 of 2012 expeditiously.
In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties.
However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge. From the ordersheet appended to this application this Court finds that dates were fixed for filing the show cause by the 10th defendant and for acceptance of the show cause petition and the written statement filed by the defendant no.8.
The learned advocate appearing for the petitioner submits that since the suit is pending from the year
2012 the learned trial judge should be directed to dispose of the suit as expeditiously as possible. In the light of the submissions made by the learned advocate for the petitioner, C.O. 1272 of 2024 is disposed of by requesting the learned Civil Judge (Junior Division), 1st Court at Barasat to dispose of the suit as expeditiously as possible without granting any unnecessary adjournments to either of the parties after the suit is made ready for hearing.
Considering the fact that the suit is pending from the year 2012 the learned trial judge is requested to dispose of the suit as expeditiously as possible within a period of one year after the suit is made ready for hearing.
No order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
