The instant appeal has been preferred against judgment and order dated 06.08.2009 passed by learned Additional Sessions Judge, 6th Fast Track Court, Bichar Bhawan Calcutta thereby setting aside the order of conviction and sentence passed by the learned Metropolitan Magistrate, 7th Court, Calcutta in connection with Case No. C 657 of 2001 acquitting the accused/respondent under Section 138 of the Negotiable Instruments Act, 1881. The CRAN 1 of 2024 being an application for compromise effectuated by and between the parties. The said application has been filed to that effect that the parties have agreed to amicably settle the dispute and decided to withdraw the case, as it appears from the paragraphs 7,8,9 and 10 of the said application.

Under the facts and circumstances, the instant appeal being CRA 236 of 2011 along with connected application is dismissed for non-prosecution.

Copy of the order and lower court records be sent to the trial court for due compliance.
