The petitioner is aggrieved by the investigation into FIR No. 105 of 2022 dated 10.04.2022 under Sections 279/304A of the IPC. FIR was registered after the cremation of the victim who is stated to have died in an accident.

The petitioner submits that he had made enquiries and has addressed a communication to the Khandaghosh Police Station, Purba Burdwan alleging foul play.

The I. O., Khandaghosh Police Station shall take into consideration the said communication at page 16, annexure-P-4 of the writ petition and record any further statement from the petitioner. Investigation may be completed within a period of three months from the date of communication of a copy of this order. The I. O., Khandaghosh Police Station shall be at liberty to approach the Magistrate for adding any section, in the event there is need for the same pursuant to investigation.

The writ petition is disposed of.

There will be no order as to costs.
