Learned advocate appearing for the petitioner submits that he was arrested for alleged recovery of 381.71 Gms. of Heroin. The Chemical Examiner's Report reflects presence of contraband being Diacetylmorphine (Heroin), 6Monoacetylmorphine, Morphine-3-acetate, Acetylcodeine, Morphine & Codeine. There has been no quantification of the same. Further, petitioner is in custody for 1 year and 3 months.

Learned advocate for the State opposes the prayer for bail and submits that charges have been framed and date has been fixed for witness action. Prosecution has relied upon 17

witnesses in order to prove its case out of which 5 witnesses have been fixed in the next schedule.

I have taken into account the period of detention of the present petitioner as also the factum that the Chemical Examiner's Report do not reflect quantification of the contrabands which have been seized and each of the contraband are separately recorded in the schedule of the NDPS Act.

Having considered the same, I am of the view that the petitioner is entitled to be released on bail. Accordingly, Petitioner, namely, Nuruddin Sk. shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Special Judge (NDPS), Raiganj, Uttar Dinajpur. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Uttar Dinajpur without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 810 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
