No.2 It appears that the present criminal proceeding was initiated on the basis of a complaint lodged by opposite party no. 2. Pursuant thereto, an F.I.R. was registered at Narendrapur Police Station, being Case No. 1009 of 2022 dated September 9, 2022, under Sections 420, 465, 468, 471 and 120B of the Indian Penal Code, 1860. Upon completion of the investigation, a charge-sheet was submitted under the aforesaid provisions. By filing the present revisional application, the petitioners have prayed for quashing of the said criminal proceeding.

It further appears that, during the pendency of the present revisional application, the parties have arrived at an amicable settlement of their disputes. In view thereof, a joint petition of compromise has been filed before this Court, being CRAN 1 of 2026. Upon consideration of the materials on record, this Court is of the view that the dispute between the parties is essentially civil in nature and that a genuine and voluntary settlement has been arrived

at between them. In such circumstances, the continuance of the criminal proceeding would serve no useful purpose and would amount to an abuse of the process of the Court. Having regard to the principles laid down by the Hon'ble Supreme Court reported at (2012) 10 SCC 303 (Gian Singh v. State of Punjab), this Court is inclined to exercise its inherent jurisdiction to secure the ends of justice by quashing the present proceeding. Accordingly, G.R. Case No. 5938 of 2022, arising out of Narendrapur Police Station Case No. 1009 of 2022 dated September 9, 2022, under Sections 420, 465, 468, 471 and 120B of the Indian Penal Code, 1860, presently pending before the learned Additional Chief Judicial Magistrate at Baruipur, stands quashed in terms of the compromise recorded in CRAN 1 of 2026.

Consequently, CRR 1737 of 2026 and CRAN 1 of 2026 stand disposed of.
