Palit Mr. Imtiaz Ahmed ......For the Opposite Party 1.The revisional application has been preferred by the petitioners praying for transfer of Money Suit no. 01 of 2016 from the Court of the Learned Civil Judge (Sr. Division), Kandi to the Court of the Learned Civil Judge (Sr.

Division), Berhampore, Murshidabad.

2.On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the Money Suit has been filed in the Court of the Learned Civil Judge (Sr.

Division), Kandi by the opposite parties herein.

3.The petitioners herein reside at Village - Basabari, P. O. Ghorigachha, P. S. Berhampore, District - Murshidabad, PIN 742405 whereas the petitioner no.1 lives in Kolkata and works as a nurse in a Govt. Hospital.

4. Considering the difficulty of the petitioners to travel to Court of Kandi on regular basis and keeping in mind that the opposite parties also reside at Berhampore, this Court directs that Money Suit No. 01 of 2016 be withdrawn from the Court of the Learned Civil Judge (Sr. Division), Kandi be transferred to the Court of the Learned Civil Judge (Sr. Division), Berhampore, Murshidabad.

5.Learned Civil Judge (Sr. Division), Berhampore, Murshidabad shall proceed with the suit in accordance with law with due notice upon both the parties.

6.Keeping in mind the case of the parties herein, the Learned Civil Judge (Sr.

Division), Berhampore, Murshidabad shall be at liberty to permit the parties to appear virtually, if such prayer is made.

7.CO 1447 of 2025 is disposed of.

8.Parties to act on the server copy of this order.

9.Let a copy of this order be sent to the concerned Courts for immediate compliance.
