02-05-2023 AKG Ct. 238 Mr. Kamal Mishra, Mr. Pratap Sanfui, Mr. Subhadeep Maitra ...for the Petitioners Mr. Souvik Nandy ...for NCTE Mr. Ashok Halder ...for Union of India In this writ petition, the petitioner has challenged an order dated March 3, 2023, whereby the National Council for Teacher Education rejected the prayer of the petitioner to reduce the seats of D.El.Ed programme and to increase the seats of B.Ed. programme of the relevant college on the ground that there is no such provision in National Council for Teacher Education Act, 1993. It has been submitted by Mr. Kamal Mishra, learned advocate appearing for the petitioner that the relevant college had the recognition from National Council for Teacher Education to conduct D.El.Ed. course with hundred students. The institute is now not in a position to run the said course with full intake capacity for want of students. The institute, however, has the required infrastructure and teaching staff to run the college. He prays that the institute should be allowed by

National Council for Teacher Education to run an M.Ed. course with fifty students instead of D. El.Ed. course. For the ends of justice, I dispose of this writ petition with a liberty upon the petitioner to make a representation before the NCTE to allow the college to introduce M.Ed. course with the intake of fifty students. The petitioner will be at liberty to make such representation within a period of fortnight from date. If such representation is made, the National Council for Teacher Education shall consider the same in accordance with law within a period of one month thereafter. With the aforesaid observations, WPA 9314 of 2023 is disposed of.
