The order passed by the Additional District Magistrate and District Land and Land Reforms Officer, Jhargram on 13th December, 2022 is assailed in the writ petitioner. The said order is amenable to appeal under Rule 51 of the West Bengal Minor Mineral Concession Rules, 2016.

In view of the above, the writ petition being WPA 9317 of 2023 is dismissed as not maintainable. However, the petitioner is at liberty to approach the appropriate forum for redressal of his grievance, in accordance with law.

In the event the petitioner prefers an appeal before the appropriate forum within 15 days from date, the appellate forum shall consider the appeal on merits upon condoning the delay in preferring the same.

The authority is further requested to dispose of the appeal as expeditiously as the business of the authority may permit.

There shall be no order as to costs.
