Banerjee) Mr. Ayan Dutta Ms. Shreyasi Sanyal ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Jr. Division), 1st Court at Alipore to dispose of the injunction application and the repairing application filed in Title Suit No. 3462 of 2009 expeditiously.

Learned advocate appearing for the petitioners submits that the injunction application and the repairing application are otherwise ready for hearing. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the

learned advocate representing the opposite parties before the learned trial judge.

From the order-sheets appended to this application this Court finds that May 9, 2025 has been fixed for hearing of the injunction application as well as the application for effecting repairing works. In view thereof, CO 1448 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Division), 1st Court at Alipore to take up the hearing of the application for injunction and the repairing application on the next date fixed, if the same are otherwise ready for hearing and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
