There is an allegation of user of forged stamp paper with regard to the deed presented for registration.

In such circumstances, it would be appropriate to permit the petitioner to obtain certified copy of the deed presented for registration in accordance with law without prejudice to the rights and contentions of the parties and without prejudice to any criminal proceeding that may be pending or that may be initiated.

The petitioner will pay the difference of stamp duty, if there is any default in payment of the full stamp duty, for the purpose of registration of the deed. In the event, the writ petitioner applies for certified copy of the deed presented for registration,

the relevant authorities will issue the certified copy as expeditiously as possible and preferably within eight weeks from the date of receipt of the application for certified copy.

WPA 10438 of 2021 is disposed of accordingly. (Debangsu Basak, J.)
