ct. no. 34 CRR 1142 of 2017 + IA No. CRAN 2 of 2017(Old No. CRAN 3113 of 2017) Sudhangshu Kumar Nath & Ors.

Vs.

Monika Nath The present revisional application has been preferred by the petitioners challenging the complaint case being no.388C of 2014 under Sections 498A/34 of the Indian Penal Code. I have perused the petition of complaint, which reflects demand of dowry as well as mental torture upon the complainant. On assessment of the nature of the allegation made therein, I am of the opinion that the complaint at the inception cannot be interfered with, until and unless evidence before charge is adduced before the learned Trial Court. No interference is called for. Accordingly, CRR 1142 of 2017 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
