1. Report filed on behalf of the State is taken on record.

2. Learned senior counsel appearing on behalf of the petitioner submits that this is a second application for anticipatory bail. The change in circumstance is that a co-accused was subsequently granted anticipatory bail by this Court on 20.05.2025 in CRM (A) 1614 of 2025. Other than the statement of the co-accused, there is no material available against the petitioner.

3. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that other than the statement of the co-accused, there are criminal antecedents against the petitioner. Moreover, there was a whatsapp chat with the principal accused.

4. In view of the above, it appears that the petitioner stands on a distinct footing from the co-accused who was granted anticipatory bail.

5. In view of the above, the other materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

6. Accordingly, the application for anticipatory bail is rejected.
