Mr. Subrata Guha Biswas Mr. Sandipan Maity ...for the Petitioner In this application, the petitioner has prayed for direction upon the court below for expeditious disposal of Misc. case no. 303 of 2022, presently pending before the learned Judicial Magistrate, 4th Court, Barrackpore. Being aggrieved by the long pendency of the proceeding, learned counsel for the petitioner submits that an ex-parte order of the interim relief in favour of the petitioner was passed by the court below on 20th May, 2023. The opposite party filed an application for vacating the ex-parte order on 20.12.2025 and since then, the matter is pending for hearing of the said vacating application. Therefore, he prayed for a direction upon the court below for expeditious disposal of the vacating application as well the main application considering its long pendency.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice

and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having heard learned counsel for the petitioner and that the prayer made by the petitioner is justified and required to be allowed for securing ends of justice, the instant application being CRR 1741 of 2026 is hereby disposed of with a direction upon the court below to dispose of vacating application within a period of 30 days from the next date and thereafter to make every endeavour for expeditious disposal of the aforesaid Misc. case no. 303 of 2022 and to make best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
