Mr. Dulal Chandra Dey Mr. Soumen Bhattacharjee ... for the petitioner Mr. Ayan Banerjee ... for the respondents The writ petitioner filed an application before the respondent authority on April 30, 2001 for allotment of quarter in Baidyabati Housing Society. His grievance is that the respondent authority has not allowed his prayer for allotment of quarter though the respondent authorities have allotted the quarter to other persons without following the required procedure. The writ petitioner submitted a representation dated January 20, 2020 praying for allotment of flat in the said Housing Society which is still pending for consideration. Since, a representation has been made, the respondent authority is duty bound to take a decision on the same and communicate his decision to the petitioner.

After hearing the learned advocates of the respective parties and upon considering the materials on record, WPA 6985 of 2020 and CAN 1 of 2020 are disposed of by

directing the respondent no.2, i.e. The Estate Manager, Government of West Bengal, Estate Directorate & ExOfficio Deputy Secretary, Housing Department, New Secretariat Building, 1st floor, Kolkata-700 001, to consider and dispose of the representation dated January 20, 2020 being Annexure "P-13" to the writ petition by passing a reasoned order as expeditiously as possible and preferably within a period of four weeks from the date of communication of this order. Needless to mention that the respondent authority shall afford an opportunity of hearing to the writ petitioner and all other interested parties in this regard. The reasoned decision shall be communicated to all the parties immediately thereafter. Since, no affidavit in opposition has been used by the respondents, the allegations contained in the writ petition shall not be deemed to have been admitted by the respondents.
