This is an application under Section 378 (4) of the Code of Criminal Procedure praying for special leave to file appeal by the de facto complainant/appellant against the Judgement and order of acquittal passed by the Learned Judicial Magistrate, 1st Court at Malda.

The application was filed within time and in form. Though the Learned Advocate for the petitioner is found absent, this Court inclines to grant leave to prefer appeal against the Judgement and order of acquittal dated 5th March, 2021 in G. R. Case No. 1781 of 2011. The petitioner is at liberty to file memorandum of appeal within 30 days from the date of this order.
