For the State The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure in connection with Jangipara Police Station Case No. 8 of 2021 dated 08.01.2021 under Sections 147/148/149/323/325/304/504/506/120B of the Indian Penal Code. The petitioner is in custody for 199 days in connection with the aforementioned case and seeks for bail on the ground that the similarly circumstanced co-accused has been enlarged on bail by this Court in CRM 1585 of 2021 on 20th April 2021.

After perusing the tenet of the said order recorded by the co-ordinate Bench, we find that there was an overt act of assault at the behest of the present petitioner and his prayer was rejected on such score. Since we do not find any changed circumstances except the length of the detention, the prayer for bail of the petitioner is hereby rejected. The Trial Court is requested to expedite the trial and bring to its logical end at an earliest The application for bail being CRM 3675 of 2021 is dismissed. (Harish Tandon, J) (Bibek Chaudhuri,J.)
