It is submitted on behalf of the appellants that the appellants do not want to proceed with the second appeal. Written instructions from the appellants addressed to the learned advocate on record is kept on record. Mr. Amal Kumar Saha, respondent No.1 does not raise any objection.

Mr. Chakraborty, learned advocate for the Indian Oil Corporation Limited submits that when the parties have resolved the disputes, the Indian Oil Corporation Limited does not stand in the way.

Accordingly, the second appeal is dismissed as withdrawn without liberty to file afresh on the self-same cause of action.

Interim order, if any, stands vacated.
