For the State The present revisional application has been preferred challenging the order dated 18.03.2011 passed by the learned Chief Judicial Magistrate, Howrah, in connection with Bally Police Station case No. 384 dated 29.09.2010. The Order dated 18.03.2011 reflects that the learned Magistrate on receipt of the charge-sheet dated 30.01.2011 was pleased to take cognizance of the offences and issue warrant of arrest against the absconding accused persons. By the same order the learned Magistrate was pleased to fix 27.05.2011 for Execution Return, appearance and supply of copies.

Records of the revisional application reflect that a Coordinate Bench of this Court on 17.05.2011 was pleased to direct the petitioner to effect service upon the opposite party, further there was no interim order restraining the further proceedings before the learned Court below. Having regard to the period of time which has expired in the meantime and the present stage of the proceeding before the learned Chief Judicial Magistrate, Howrah has not been brought to the notice of the Court, I am of the view that no interference is called for.

Accordingly, CRR 1464 of 2011 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
