IN THE HIGH COURT AT CALCUTTA
CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE (Through Video Conference) CRR 1466 of 2011 In Re: An application under Article 227 of the Constitution of India, alternatively an application under Section 482 of the Code of Criminal Procedure. In the matter of : Smt. Gopa Sarkar & Anr
...Petitioners.
Mr. Arijit Ganguly, Mr. Saryati Dutta ... For the State The present revisional application has been preferred challenging the FIR registered against the present petitioner being Nowapara Police Station case no. 60 dated 31.03.2011 under the relevant provisions of the West Bengal Land Reforms Act, 1955.
Record of this revisional application reflects that on 19.05.2011 a Coordinate Bench of this Court pleased to direct the investigation to continue but no reports should be submitted in final form without the leave of this Court.
Having regard to the fact that the investigation commenced in the year 2011 the investigation presumably by this time has been completed. As such the investigating authorities are directed to file/submit the report under Section 173 of the Code of Criminal Procedure before the jurisdictional Court. No interference as such on the merits of the FIR is intended by this Court at this stage. Accordingly, CRR 1466 of 2011 is dismissed.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
