IN THE HIGH COURT AT CALCUTTA

CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE (Through Video Conference) CRR 1474 of 2011 In the matter of : An application under Section 401 read with Section 482 of the Code of Criminal Procedure; And In Re: Rathin Sutradhar & Ors.

......Petitioners.

The revisional application was preferred challenging the order dated 11.03.2011 passed by the Learned Judicial Magistrate, 6th Court, Bankura wherein the Learned Judicial Magistrate was pleased to reject the application/petition filed by the petitioners on 03.01.2011 in connection with Complaint Case No. 165 C of 2010 under Section 498A/506 of the Indian Penal Code.

I have perused the order dated 11.03.2011 and I find that the issue which was canvassed by the present petitioners related to jurisdiction. The learned Magistrate on appreciation of the same and on holding that the complainant was threatened at the place which was within

the jurisdiction of the Learned Court, rejected the argument advanced by the petitioner, as well as the petition. Having regard to the reasons given by the Learned Magistrate, I am of the view that the order was based on factual foundation adhering to the law and as such no interference is called for.

Accordingly, CRR 1474 of 2011 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
