Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Mr. Manoranjan Mahata, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

The petitioner is complainant on whose instance Madhyamgram Police Station Case No. 439 of 2019 dated 14.10.2019 was registered for investigation. On conclusion of investigation, charge-sheet was submitted before the jurisdictional court. However, the grievance of the petitioner is that till date, there has been no progress in the case. In view of the grievance expressed by the petitioner that only one witness out of nine witnesses has been examined till date, I direct that the learned Additional Chief Judicial Magistrate, Barasat would fix at least one date on each and every 60 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. The learned public prosecutor conducting the case would produce the materials, exhibits and documents on the date fixed for examination of the witnesses.

No unnecessary adjournment should be granted to either of the parties.

The learned trial court would in case of necessity take assistance of any superior officer of police in case the witnesses are reluctant to appear before the court. All efforts be taken for concluding the trial of the case at the earliest. With the aforesaid observations, the revisional application being CRR 1431 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
