The order dated 15.06.2023 passed by this Court is hereby recalled as the same has been wrongly transcribed and signed by this Court. The same may be replaced by the following order :

"Petitioner is directed to serve a copy of the revisional application upon Ms. Sujata Das, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course.

Learned advocate for the State is directed to produce the case diary on the next date fixed for hearing.

The issue relating to expeditious disposal will be considered on the next date fixed for hearing when the matter would appear under the heading "To Be Mentioned" on 21st June, 2023. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court." Learned advocate appearing for the petitioner submits that the petitioner initiated this case in the year 2019 and till date, there has been no progress in the case. Learned advocate submits that the next date has been fixed in the month of August 2023 for consideration of charges. According to the learned advocate, prosecution has proposed to rely on ten witnesses to prove its case.

Ms. Das, learned advocate appearing for the State has produced the case diary.

I have perused the statement of the victim recorded under Section 164 of the Code of Criminal Procedure. Having considered the subject-matter of the allegations, I am of the view that already four years have expired since initiation of the instant case. As such, the learned trial court, after framing of charges in the month of August 2023, would, in every 45 days, fix schedule consisting of three dates. No unnecessary adjournment should be granted to either of the parties.

The learned public prosecutor conducting the case would produce the materials, documents and exhibits on the date so fixed.

All efforts be taken to conclude the trial of the case at the earliest.

With the aforesaid observations, the revisional application being CRR 1432 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
