The petitioner is in custody for more than 8 years and prays for bail solely on the ground of his prolonged detention. Learned counsel for the State opposes the prayer and submits that the prosecution proposes to examine 30 witnesses out of whom 14 witnesses have been examined.

The petitioner is in custody for more than 8 years. There is little possibility of trial being concluded in near future. He may be granted bail solely on the ground of touchstone of Article 21 of the Constitution of India without going into the merits of the cae. Accordingly, prayer for bail is allowed.

The petitioner namely Md. Pappu@ Nur Alam @ Noor Alam be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Alipore, subject to condition that he shall remain within the jurisdiction of Tiljala Police Station except for appearing before the learned trial Court and shall appear before the

learned trial Court on every date of hearing. He shall not intimidate witnesses or tamper with evidence in any manner whatsoever. In the event the petitioner fails to adhere to any of the conditions stated above, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

The application for bail is disposed of.
