Considering urgency pleaded by petitioners in CAN 1 of 2020, the writ petition is taken up for hearing via video conference.
Accordingly, the application being CAN 1 of 2020 is disposed of.
Private respondents go unrepresented. Affidavit of service shows dispatch by post.
Mr. Mandal, learned advocate appears on behalf of petitioners. He submits, his clients want to move Court for protection of the land, nature and character of which is sought to be changed by private respondents. The Administration, impleaded by the offices made parties as respondent nos. 1 to 6, have omitted to act, which is why his clients are before Court.
Mr. Galib, learned advocate appears on behalf of State and submits, there is dispute between
petitioners and private respondents. On query from Court he submits, till there is adjudication between them, the Administration shall see that status quo will be maintained. He submits further, neither petitioners nor private respondents have approached the office of B.L. & L.R.O., Namkhana for adjudication regarding their conflicting claims over the land.
The Administration, impleaded by respondent nos. 1 to 6, through respondent nos. 2 to 5 and/or 6 shall see that petitioners and private respondents do not take the law in their own hands but ensure that they have adjudication of their claims and counter claims.
With above observation, the writ petition is disposed of.
