The petitioner is aggrieved that the respondent no. 6 is running a factory for manufacturing food products in violation of the Pollution Control Board norms.

The petitioner refers to a decision of the National Green Tribunal, Eastern Zone Bench, Kolkata dated 7th October, 2021 where certain observations have been made.

This Court is the view that the remedy of the petitioner is to seek enforcement of the order of the Tribunal in accordance with law.

However in so far as the allegations of the petitioner is concerned that he has been physically assaulted by the respondent no. 6, Kandi Police Station shall ensure that there is no breach of peace in

the area and shall continue to maintain a strict vigil thereat.

Report in the form of instructions of the Inspector-in-charge, Kandi Police Station dated 21st September, 2022 addressed to the Government Pleader, High Court, Calcutta be taken on record. With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
