Arindam Kundu v. Subrata Mitra
Sr.30 26-08-2021 Subha.
Court no. 34
IN THE HIGH COURT AT CALCUTTA
CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1333 of 2012 In the matter of : Arindam Kundu .....petitioner. In Re : An application under Section 482 of the Code of Criminal Procedure.
The revisional application was preferred in the year 2012 and the record reflects that there have been no effective participation of the learned counsel appearing for the petitioner or for the opposite party. The subject matter of challenge in this revisional application relates to the order dated 7th December, 2010 passed by the learned Metropolitan Magistrate, 3rd court, Calcutta. The said order relates to issuance of process.
Having regard to the time which has elapsed in the meantime and the provisions of the N. I. Act specifically contain a schedule within which the trial is to be completed, I am of the view that further pendency of the revisional applicastion before this court is unwarranted.
Accordingly, the revisional application being CRR 1333 of 2012 is dismissed.
All pending applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
