CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1334 of 2012 In Re : Md. Ganiul Islam Khan ........Petitioner.

In the matter of : An application under Sections 401 read with Section 482 of the Code of Criminal Procedure. The subject-matter of the revisional application relates to an order dated 24th January, 2012 passed by the learned Judicial Magistrate, 2nd Court, Malda in connection with an application under Section 127 of the Code of Criminal Procedure in Case No. 178M/2010 wherein the learned Magistrate was pleased to enhance the maintenance amount to the tune of Rs.1000/-.

Having regard to the fact that the said order was passed in the year 2012 and the quantum of maintenance being Rs.1000/- which was awarded after enhancement, I am of the view that no interference is called for by this court. Accordingly, the present revisional application being CRR 1334 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

The wife/opposite party will be at liberty to recover the arrears by taking out an appropriate application before the learned Magistrate.
