It is submitted on behalf of the State that in connection with Belgharia Police Station Case No.96 of 2021, the petitioner prayed for bail under Section 439 of the Code of Criminal Procedure which was registered as CRM 4147 of 2021. The said criminal motion was disposed of by a Co-ordinate Bench on 15th July, 2021 granting bail to the accused/petitioner. The instant criminal motion has been filed praying for bail in connection with the same police station case and special case number. Therefore, the instant criminal motion becomes

infructuous as the accused are enlarged on bail in CRM 4147 of 2021 arising out of the same police station case. Therefore, the instant criminal motion is dismissed for non-prosecution.
