Mrs. Soni Ojha for the petitioner The petitioner prays for disposal of the application made under Section 14(1) of the SARFAESI Act, 2002. The said application was filed on 20th February 2019. None appears on behalf of the respondents to oppose the application.

In view of the order that I propose to pass no useful purpose will be served by keeping the writ petition pending.

The writ petition is accordingly disposed of by directing the District Magistrate, Howrah being the respondent no. 2 herein to consider and dispose of the application made by the petitioner under Section 14(1) of the SARFAESI Act, 2002. Consideration shall be made strictly in accordance with law within a period of eight weeks from the date of communication of a copy of this order. The said respondent shall communicate the reasoned order to the petitioner within a fortnight thereafter.

It is made clear that this court has not gone into the merits of this case and all points are left open to be

decided by the said respondent at the time of consideration of the application of the petitioner. The writ petition being WPA No. 7016 of 2020 along with the connected application being IA CAN 1 of 2020 are disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
