Sri Sanat Mondal Mr. Santanu Barik Mr. Mojaffar Sk ....for the petitioner This application under Article of the Constitution of India is at the instance of the decree holder praying for a direction upon the learned Civil Judge (Jr. Div.), 1st Court at Diamond Harbour to dispose of Misc. Case No.18 of 2024 arising out of Title Execution Case No.8 of 2009 expeditiously.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates appearing before the learned Executing Court.

From the order sheets appended to this application, this Court finds that June 2, 2025 has been fixed for the filing of amended petitions, payment of cost by the petitioner to the opposite parties and, thereafter for peremptory hearing of the miscellaneous case.

It appears from the order sheet that the plaint along with compiled petition and receipt of Rs.200/- as cost was filed by the decree holder.

Accordingly, CO 1457 of 2025 is disposed of by requesting the learned Executing Court to dispose of the Miscellaneous Case No.18 of 2024 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
