Kausik (Allowed) CRM (NDPS) 816 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Gazole Police Station Case No. 809 of 2025 dated 17.08.2025 under Sections 21(c)/27A/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that, so far as the other accused is concerned, namely, Mosaraf Sk @ Chaku, he has been granted bail in CRM (NDPS) 639 of 2026. There has been no recovery from the present petitioner. Although, the subject matter of the case relates to recovery of 414 Gms. of Brown Sugar.

Learned advocate for the State opposes the prayer for bail and submits that although there was no recovery from the present petitioner, there are call detail records reflecting the connection of the present petitioner with the other accused. Having considered that the accused, from whom recovery has been made, has been granted bail in CRM (NDPS)

639 of 2026, I am inclined to extend the same benefit to the present petitioner.

Learned Trial Court would, on the same terms and conditions, as was imposed upon the other accused in CRM (NDPS) 639 of 2026, release the petitioner on bail. Accordingly, CRM (NDPS) 816 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
