However, till date, trial has not been completed and the petitioner is unnecessarily detained behind the bar, although, there was a direction passed on 08.12.2025 in CRM (M) 2576 of 2025.

Mr. Mondal, learned Public Prosecutor, appearing for the State, emphasis on the fact that the period for which the court fixed the schedule incorporated SIR which was an unforeseen circumstance. There are two more witnesses to be examined, as such, the prosecution be given another two months' more time to complete the trial.

The earlier order dated 08.12.2025 reflects that the court after considering the version of the State granted an opportunity till 31st March, 2026. The order of the learned trial court dated 20.04.2026 reflects certain grounds which depict the reasons why the trial could not proceed. This court, however, has not assessed the factum as to who contributed to the delay but is of the opinion that at least this petitioner did not contribute to the delay. Having considered the same, I am inclined to release the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Dimple Jund shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned CJM, Alipore. If on bail, the petitioner shall also make herself physically available on each and every date so fixed by the learned trial court and shall not enter into the jurisdiction of Gariahat Police Station and Ballygunge Police Station till further orders of this court.

Additionally, the petitioner would furnish her address where she would be residing to the learned trial court prior to her release. The Investigating Officer of the case would

be at liberty to crosscheck regarding the presence of the petitioner at the said address by way of surprise visits. Accordingly, CRM (M) 1020 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
