Mr. Pratick Bose ..for the State Learned advocate for the petitioner submits that the petitioner pursuant to the receipt of notice under Section 41A of the Cr.P.C complied with the same and has also made partial payments to the defacto complainant. Learned advocate submits that there is no scope of absconding from the process of law and as such petitioner may be extended the benefit of 438 Cr.P.C. Mr. Mukherjee, learned advocate appearing for the State opposes the application and submits that the petitioner committed to the defacto complainant for providing job and the defacto complainant on receipt of the appointment letter had been to the office wherein the same was found to be a fake letter of appointment.

We have taken into account the materials available in the case records along with memorandum of evidence wherein the nature and gravity of the offence reflects that it would not be fit and proper to extend the benefit of anticipatory bail to the present petitioner.

Accordingly, prayer for anticipatory bail is rejected. With these observations, CRM 6390 of 2020 and CRAN 1 of 2020 are disposed of.
