IN THE HIGH COURT AT CALCUTTA

Item No.5 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 1352 of 2012 (Via Video Conference) Asraful Chisti versus Neha Afrin Parvin & Ors.

In Re: An Application under Section 401 read with Section 482 of the Code of Criminal Procedure.

Mr. Musharraf Alam Sk.

... For the Petitioner.

The present revisional application has been preferred against the judgment and order dated 24.01.2012 passed by the learned Additional District & Sessions Judge, Fast Track, 2nd Court, Malda in connection with Criminal Revision No. 72 of 2011 wherein the learned sessions court was pleased to dismiss the criminal revisional application and affirmed the order dated 09.06.2011 passed by the learned Chief Judicial Magistrate, Malda in Case No. 644M/09 (T.R.No. 50/10). I have perused the order so passed by the learned sessions court while exercising its revisional jurisdiction. The learned advocate appearing for the petitioner submits that during the pendency of the revisional application, all the children have become major. Having regard to the contentions so advanced, I am of the view that the petitioner would be at liberty to bring the same to the notice of the learned Magistrate with proper proof for reconsideration of the maintenance whether the same is required to be continued or not.

So far as the order of the learned sessions court is concerned, the same does not call for any interference. As such, the revisional application being CRR 1352 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
