Despite service, none appears on behalf of the private respondent.

Learned counsel for the petitioner contends that, due to resistance put up by the private respondent no. 4, the CESC Limited is not being able to give new electricity (service) connection to the petitioner. It is further submitted that the petitioner has already complied with the due formalities in that regard.

Learned counsel for the CESC Limited corroborates the contentions of the petitioner insofar as the inability of the CESC Limited officials to give such service connection due to resistance being created by the respondent no. 4 is concerned.

Since the private respondent no. 4 chooses to abstain from hearing despite being served, the writ petition is being adjudicated in the absence of the private respondent.

WPA No. 9027 of 2022 is disposed of by directing the CESC Limited to give the new service connection to the petitioner pursuant to the petitioner's application, subject to compliance of all formalities by the petitioner, as expeditiously as possible, positively within three weeks from date. It is made clear that in the event the CESC Limited personnel face any obstruction in doing so, it will be open to them to approach the respondent no. 3, the Officer-in-Charge of the Beniapukur Police Station, for adequate police assistance. If so approached, the respondent no. 3 shall give such police assistance at the cost of the petitioner and the police personnel shall be at liberty to remove any padlock or hindrance for giving access to the CESC personnel at the proposed meter board position. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
