Mr. Chowdhury, learned advocate appearing for the opposite party no.2 submits a photostat copy of the order passed by the learned Additional Chief Judicial Magistrate, Sealdah wherein it reflects that final report has been submitted as mistake of fact and there has been prayer for discharge of the accused persons at the instance of the State/Investigating Officer.

Having regard to the subject-matter of the revisional application and the prayer so advanced, I am of the view that the present revisional application has become infructuous. Accordingly, the revisional application being CRR 1435 of 2023 along with the connected application is dismissed as infructuous.

The de facto complainant/opposite party no.2 as directed by the learned Magistrate in his order dated

11.09.2023 would in the circumstances take steps in accordance with law.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
