14.06.2022 Item No. 6 Ct. No. 40 AKG W.P.A. 9030 of 2022 r Farhina Rahima Vs.

The Union of India & Ors.

Ms. Karunamoyee Samanta ...For the Petitioner Ms. Kanika Gupta ...For the Respondent No. 1 Mr. U. S. Menon, Mr. Abhirup Chakraborty ...For the Respondent Nos. 2 & 3.

Mr. Samrat Sen, Mr. Tapas Ballav Mandal ...For the Respondent Nos. 6, 7 & 8.

Mr. Indranil Roy, Mr. Sunil Kumar Roy ...For the National Medical Commission Mr. Saibalendu Bhowmick, Mr. Biplab Guha, Mr. Rajsekhar Basu, Mr. Subrata Bhattacharya ...For the Respondent No. 5 The petitioner seeks admission in M.B.B.S.

Course on the strength of her performance in National Eligibility cum Entrance Test (UG)-2021 against the available vacancies.

It has been submitted by the learned advocate appearing for the National Medical Commission that in terms of the judgment, reported at (2016) 11 SCC 225 (Ashish Ranjan v.

Union of India), the last date for admission in the medical course has been fixed on 31st May of that particular academic year. However, by a subsequent order dated May 9, 2022, the Hon'ble Supreme Court had extended the time till April 28, 2022, keeping in mind the pandemic situation. The petitioner seeks admission beyond the scheduled time fixed by the Hon'ble Supreme Court. The petitioner cannot be admitted to a medical course at this juncture.

I do not find any merit in this writ petition. Accordingly, W.P.A. 9030 of 2022 is dismissed. Let urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all necessary formalities. (Kausik Chanda, J.)
