Petitioners claim to be title holders and allege that the private respondents are trying to encroach and disturb their possession.

Learned advocate for the State has submitted a report by the Officer-in-Charge, Gosaba Police Station. It has been alleged that the nature of the dispute complained of is civil dispute and can only be adjudicated by the competent civil court.

Admittedly, it is found that the property is undemarcated. Having regard to the same and the fact that there is a dispute existing between the petitioners and the private respondents, police authorities would oversee that there is no breach of the peace and/or tranquility and/or any untoward

incident resulting because of the strained relationship existing between the parties.

With the aforesaid observations, WPA 9442 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
