Rohit Jain Mr. Debarshi Brahma, Mr. Samrat Choudhury, Mr. Sagnik Mukherjee ...for the petitioner Upon adverting to order, dated 19th June, 2019, passed in C.O.201 of 2019 directing the court below to expedite the hearing of an application proposing amendment within a period of four (04) weeks from the date of communication of the order, learned advocate for the petitioner submits that till date, the pending amendment application has not yet been disposed of. No other point is raised, requiring address by this Court.

In view of the nature of order proposed in this case, no prior notice is considered to be necessary. Service of notice upon the opposite party stands dispensed with.

Accordingly, learned Civil Judge (Junior Division), 2nd Court, at Berhampore, District-Murshidabad, in Misc. Case No.37 of 2009 is requested to ensure expeditious disposal of pending application for amendment, providing sufficient opportunity of hearing to either of the parties to this case, but without

granting any unnecessary adjournment, unless it is extremely unavoidable, upon sensing the message contained in C.O. No.201 of 2019.

This would not, however, prevent the court below to dispose of the pending amendment application on the date already fixed by the court below.

It is, however, clarified that if for any reasons whatsoever, the same could be done, the application for proposed amendment maybe disposed of within a period of four (04) weeks peremptorily taking into the direction passed in C.O.201 of 2019..

Petitioner is directed to make communication of this order to the learned court below as well as to the opposite party and his advocate in the court below. With this observation/direction, the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
